Ranchi, Dec.6: A span of 10 days is not sufficient for a lower court order to reach the right place for necessary legal action in Jharkhand.
This was reflected after officer-in-charge (OC) of the ST-SC police station Radhika Raman Minz told Lagatar24.com that the FIR against him and Ranchi city S.P, a close associate of chief minister Hemant Soren, Pankaj Mishra, and deputy superintendent of police Pramod Kumar Mishra could not be registered.
Asked why about the delay when the order was given on November 26 and the copy of the order reached everywhere including media persons by December 1, OC Minz cited the delay in receiving official information in this regard as reason.
“Official information in this regard is yet to reach the police station. Once the order comes, it will certainly be complied,” the OC, whom the court has accused, for his reluctance in registration of an FIR in a matter related to sub-inspector Rupa Tirkey’s death, said.
A high court advocate said this is not unusual.
“The POCSO court in a case passed an order to register an FIR at Dhurwa police station on November 23 but the same has not reached the police station so far for proper legal action,” the high court lawyer said.
A police official admitted the problem saying ‘unless senior officials are not interested, documents for registration of the FIR move slowly.’
‘As far as the matter related to Rupa Tirkey is concerned any attempt to act expeditiously will put police officials in trouble as it has become a high profile case and the CBI has already intervened into it,” the police official said.
The court had passed the order exercising its power under section 156 (3) of CrPC. The court had made viral audios based on the FIR. The viral audio was provided by Padmavati Oraon, the mother of the deceased, to the court on September 23 saying police officials in Ranchi were reluctant to register an FIR in the matter.
In the audio abusive languages were being used by dy SP Mishra. Apart from this, there was also communication between Tirkey and her friend and batch mate Shiv Kumar Kanaujia.
