Ranchi, Dec.2: It remained a herculean task for police officials in Jharkhand capital to decide who will register an FIR against officer-in-charge of ST-SC police station Radhika Raman Minz and S.P.(city) Saurav besides representative of chief minister Hemant Soren, Pankaj Mishra and deputy superintendent of police Pramod Kumar Mishra following direction of the court of Special judge Vishal Srivastava on November 26.
It was realised when work of registration of the FIR could not be completed till late evening and officer-in-charge of ST/SC police station Minz appeared confused.
“How can I register an FIR against myself and my senior officer? I am waiting for a proper direction in the matter. A meeting will take place in the matter at 8pm,” Minz said when contacted in the evening at the ST/SC police station on Line Tank Road close to Albert Ekka Chowk.
Minz was so confused about the matter that he was even heard of someone approaching him for some help in a police matter saying that ‘law does not spare anyone. There is a direction to register an FIR against me.”
Contacted S.P.(city) Saurav, he flatly refused to comment saying he is a party. “Don’t ask any question in the matter. I am a party,” the young IPS officer said, facing the situation for the first time in his career.
Senior superintendent of police, S.K.Jha, too appeared in a fix. “I will call you,” he said when asked about the matter but later neither responded to the call nor called.
Contacted a high court lawyer for his opinion in the matter, he, however, said that the matter is not so confusing.
“The Court must have directed someone to the action. If the person is SSP, he will decide to whom he will assign the task of registering the FIR. Naturally a person is not supposed to register an FIR against himself and the officer-in-charge of the concerned police station cannot register FIR against himself. However, any person of the same police station can register the FIR,” the lawyer said without going into the details of the case.
The ST/SC special judge exercising his power under section 165(3) of CrPC directed registration of FIR at ST SC police station in the Jharkhand capital in a matter related to death of sub-inspector Rupa Tirkey, whose body was found hanging at her official residence in Sahibganj.
The development took place after mother of Tirkey, Padmavati Oraon, knocked the door of the court on September 23 alleging that her FIR was not registered at ST/SC Police station when she went there with a viral audio in which abusive language was being used against her daughter.
