New Delhi, Aug 2: The Supreme Court started hearing the petitions demanding the restoration of Article 370 in Jammu and Kashmir on Wednesday, August 2. It is reported that a constitution bench of five judges headed by Chief Justice DY Chandrachud will hold hearings every day from today. The hearing will be held on every day except Monday and Friday. Only new petitions are heard in SC on Mondays and Fridays, regular matters are not heard.
Apart from CJI, Justice Sanjay Kishan Kaul, Justice Sanjeev Khanna, Justice B.R. Gavai and Justice Suryakant will be presiding over the hearing on Article 370. Kapil Sibal and other veteran lawyers will present arguments on Article 370. According to the information, 18 lawyers are included in the list. 60 hours of time has been fixed for the debate. Today Kapil Sibal will start the debate.
In the Article 370 case, the Supreme Court had fixed July 27 as the deadline for filing the written arguments of various parties and the details of the case (Convenience Compilation) on July 11. According to information, the Supreme Court had appointed a lawyer each on behalf of the petitioners and the government to prepare the prospectus and file it before July 27.
The court had clearly said that no document will be accepted later. The summary of the entire case remains in the brochure, which helps the court to understand the facts quickly. It has been said on behalf of the bench that the affidavit filed by the Center on Monday regarding the status of the erstwhile state of Jammu and Kashmir after the August 5, 2019 notification will not have any impact on the constitutional issue being heard by the constitution bench.
