SC dismisses plea against appointing Justice DY Chandrachud as CJI

New Delhi, Nov 2: The Supreme Court on Wednesday rejected a plea against appointment of Justice DY Chandrachud as the country’s next Chief Justice (CJI). The plea, according to a bench consisting of CJI UU Lalit, Justices S Ravindra Bhat, and Bela M. Trivedi, was entirely misconceived.

“We see no reason to entertain this petition. The entire plea is completely misconceived. Thus dismissed,” the Court ordered.

This issue was raised for urgent consideration in the morning. At 12:45 PM today, the case was scheduled for admission before us, and the attorney who raised the issue was permitted to make his argument.

According to the plea filed by lawyer Mursalin Asijit Shaikh, Justice Chandrachud had acted in wilful disregard and deliberate defiance of binding precedents of larger benches of the Supreme Court and denied justice to deserving litigants on twelve occasions.

The complaint further claimed that Justice Chandrachud took on a case involving the client of his son without notifying the respondents, who included the State government, and issued an ex-parte order.

The plea noted that the second problem had already been brought up by one RK Pathan in a complaint to the CJI and the President of India.

Along with criminal charges for contempt of court and other offences against Justice Chandrachud, the petition also pleaded with the Central government to forgo designating him as Chief Justice of India.
