New Delhi, July 11: The National Green Tribunal’s (NGT) ruling designating Delhi Lieutenant Governor Vinai Kumar Saxena as the head of a high-level committee overseeing the Yamuna rejuvenation project was stayed by the Supreme Court on Tuesday.
A petition by the Delhi government contesting the National Green Tribunal (NGT) ruling dated January 9, 2023, was given notice by a bench consisting of Chief Justice of India DY Chandrachud, Justices PS Narasimha, and Manoj Misra.
In their argument, the Delhi Government claimed that the appointment of LG as Chairperson was a “violation of the constitutional scheme of governance” and two Supreme Court Constitution bench rulings issued in 2018 and 2023.
The NGT established the committee to solve the Yamuna pollution problem in January of this year.
The executive powers provided to the LG by the NGT order, according to the government, “encroach upon areas exclusively under the competence of the elected government.”
It expressed vehement opposition to the executive authority granted to the LG by the NGT order.
The government argued that the elected leader of the government, in this case the Chief Minister, should be in charge of handling the problem of pollution in the Yamuna river.
The NGT’s decision was made in response to a petition by Ashwani Yadav, which highlighted the rising pollution levels in the Yamuna River and the failure of the authorities to take appropriate action.
