SC to pronounce verdict on validity of EWS quota on Nov 7

New Delhi, Nov 6: The Supreme Court will pronounce its verdict on a batch of pleas challenging the validity of the 103rd Constitution amendment providing 10% reservation to the economically weaker sections (EWS) people in admissions and government jobs tomorrow.

A five-judge panel that included the Chief Justice of India, UU Lalit, Justices Dinesh Maheshwari, S Ravindra Bhat, Bela M Trivedi, and JB Pardiwala heard the case over the course of seven days.

According to the causelist, the EWS Quota case has two judgements from Chief Justice UU Lalit and Justice S Ravindra Bhat. Notably, Chief Justice UU Lalit will step down on November 8, 2022.

The petitions contested the constitutionality of the 2019 Constitution (103rd Amendment Act). Articles 15 and 16 of the Constitution were amended by the Parliament in January 2019 to include clause (6), which would provide for economic reservation in employment and education.

The cases were submitted to the Constitution Bench by a three-judge panel on August 5, 2020, which included the then-CJI SA Bobde, Justice R Subhash Reddy, and Justice BR Gavai. Some of the concerns raised were whether the 50% reservation cap may be exceeded in certain cases and if affirmative action could be given based only on economic standing.
