Shiv Sena case: SC constitution bench reserves judgment

New Delhi, March 16: A Supreme Court Constitution Bench on Thursday deferred ruling on a number of issues involving the split in the Shiv Sena party between the parties commanded by Uddhav Thackeray and Eknath Shinde that resulted in the change of Maharashtra’s government in July 2022.

The petitions submitted by members of the Shinde and Thackeray organisations regarding a number of concerns are included in the batch. Eknath Shinde filed the first petition in June 2022, objecting to the notifications sent by the then-Deputy Speaker to the rebels over alleged defection under the tenth schedule of the Constitution.

Thereafter, the Thackeray group petitioned the Supreme Court to dismiss cases challenging the Maharashtra Governor’s decision to call for a confidence vote, Eknath Shinde’s swearing-in as the government’s Chief Minister with support from the BJP, the choice of a new Speaker.

Notably in August 2022, a 3-judge bench led by the then Chief Justice of India NV Ramana referred the petitions to a Constitution Bench.
