Ranchi: The Jharkhand High Court has observed that the cancellation of a tender related to generator supply in extremism-affected police stations appears to have been done with malafide (bad) intent. The court has put a stay on the cancellation order until further notice.
The division bench of Chief Justice M.S. Ramachandra Rao and Justice Rajesh Shankar was hearing a writ petition filed by supplier firm M/s G.S. Enterprises, which claimed that despite successful delivery of goods, payment had not been made and the tender was cancelled arbitrarily.
Court Issues Stay On Cancellation Order
The High Court has scheduled the next hearing of the case on July 8, 2025, and until then, the cancellation order dated March 27, 2025, issued by the Jharkhand Police Department, will remain suspended. The court has also directed the police officials named as respondents in the case to file affidavits.
Background of the Case
M/s G.S. Enterprises had filed the writ petition on March 25, 2024, stating that it had successfully bid for a tender floated by the Jharkhand Police to supply 64 generators of 10 KVA each to police stations located in extremism-affected districts.
Following the tender process, the firm was issued a work order, and it duly supplied all 64 generators. After delivery, the police department constituted a technical team to inspect the supplied generators. The inspection team confirmed that the generators met all required standards.
However, despite this verification, the firm did not receive payment. Instead, after the writ petition was filed, the police cancelled the entire tender on March 27, 2025.
Firm Seeks Rs 2.66 Crore Payment
Following the cancellation, G.S. Enterprises filed an Interlocutory Application (IA) in the High Court, demanding that the cancellation be declared illegal and requesting the court to direct the police department to pay ₹2.66 crore for the supplied generators.
During the hearing, the High Court noted the suspicious timing of the cancellation and indicated that the action appeared to have been taken with dishonest intent. It has, for now, blocked the cancellation order from being implemented.
