Court Criticizes Vulgarity Masquerading as Talent
The controversy erupted after Allahbadia’s crass remark on the roast show India’s Got Latent, where he posed an inappropriate question to a contestant. The viral clip triggered widespread backlash, leading to multiple police complaints against him and others involved in the show.
His counsel Abhinav Chandrachud argued for lifting restrictions, citing that his show employs 280 people. Meanwhile, Solicitor General Tushar Mehta told the court that Allahbadia’s remark was not just vulgar, but perverse.
Supreme Court Calls for Balanced Regulations
The Supreme Court bench, comprising Justice Surya Kant and Justice N Kotiswar Singh, observed that while there should not be censorship, digital platforms cannot be allowed to operate in a free-for-all manner. The court asked the Centre to frame regulations that uphold free speech but ensure moral responsibility in digital content.
The top court stressed that using filthy language cannot be considered talent, adding that family-friendly humorshould be promoted. The judges emphasized that the Constitution permits reasonable restrictions in the interest of public morality and order.
The bench instructed the Centre to consult stakeholders before finalizing any regulatory framework, ensuring that new rules do not violate free speech but curb obscenity.
