New Delhi, Dec 6: The Supreme Court has scheduled a hearing for the group of petitions submitted by the Uddhav Thackeray and Eknath Sindhe factions regarding the political unrest in the State of Maharashtra on January 13, 2023.
A bench made up of Justice PS Narasimha and Chief Justice DY Chandrachud heard the case. On November 29, 2022, the subject was initially scheduled to be posted for directions.
CJI Chandrachud said that the matter could now be posted in January for guidance after hearing it mentioned today. Senior Attorney Devadatt Kamat asked that the proceedings start sooner on behalf of the Uddhav side. However, CJI Chandrachud stated that the same would not be possible owing to the following week being a miscellaneous week in the Supreme Court.
“Next week won’t be possible because it will be a miscellaneous week. It will not be possible for five judges to sit in a Constitution Bench. Let us keep this for directions on 13th January 2023.“
On September 27, the Constitution Bench hearing the case rejected the Uddhav group’s request to enjoin the Election Commission of India from making a determination regarding the Shinde group’s assertion that it is the real Shiv Sena.
