New Delhi, July 12: The Delhi High Court on Wednesday granted bail to former MCD councillor Tahir Hussain, in five riot cases.
Hussain has been charged with a number of riot-related charges, including the murder of IB employee Ankit Sharma and the greater conspiracy of the Delhi riots. Because of further cases against him, he will stay in custody.
These incidents are related to the Dayal Pur police station area in North East Delhi.
Tahir Hussain was granted bail in five cases by Justice Anish Dayal. The court reserved the orders, on April 20, 2023.
Orders with specifics are awaited.
Bail requests were submitted by Tahir Hussain through lawyer Rizwan.
The petitioner is the primary riot conspirator, according to Delhi police, attorney Rizwan claimed in court. A number of FIRs have been filed against him, including one under UAPA for a broader conspiracy.
He made the case that only one FIR could be filed for a single offence. For the same conspiracy offence, more than one FIR cannot be filed. There isn’t a single occurrence that the petitioner is to blame for.
Additionally, the attorney claimed that the petitioner is a victim rather than a conspirator. The police rescued him out of his house. The rioters had taken up residence in his home. Other suspects have already received bail.
These incidents involve riots, shoplifting, arson and injuries from gunshots to Prince Bansal and Ajay Kumar Jha.
One case concerns the assembly of the riotous mob on Tahir Hussain’s terrace. It has been claimed that those individuals attacked houses belonging to followers of other religions while holding petrol bombs in their hands.
The Delhi Police had objected to the counsel’s claim of parity.
When arguing against the bail requests, Delhi police claimed that because he is the primary kingpin or conspirator, his involvement is completely different and unique from those of the other co-accused in the case.
It was also claimed that Tahir Hussain was directing the actions of all the other accused people.
If his bail is increased, the Delhi Police further stated that there is a possibility of evidence tampering.
