Sharjeel Imam withdraws bail application from Delhi HC in Sedition case

New Delhi, May 26: After the prosecution raised the issue of the application’s maintainability, the bail application filed on behalf of Sharjeel Imam, who is charged with sedition, was withdrawn.

In light of the Supreme Court’s recent decision on sedition law, the Delhi High Court directed Sharjeel’s lawyer to withdraw the motion and granted him the right to petition the trial court for bail.

Notably, the Supreme Court has ordered that all outstanding appeals and processes relating to the accusation of sedition under section 124A of the Indian Penal Code be stayed.

The Delhi High Court has granted Sharjeel Imam bail in a sedition charge filed against him for allegedly making anti-CAA and anti-NRC remarks. After hearing Special Public Prosecutor (SPP) Amit Prasad’s argument, a bench of Justice Mukta Gupta and Justice Mini Pushkarna issued the order.

According to the SPP, any such bail application must first go to the trial court, and only if the relief is denied may the accused proceed to the High Court, as the case is only triable by a Special Court.

After hearing the SPP, the Bench allowed Advocate Tanvir Ahmed Mir, who represented Sharjeel Imam, leave to drop the plea and proceed to the lower court.
