Ranchi, Dec.17: The ED will challenge the Jharkhand High Court order granting bail to an accused of ‘cash for PIL’ Rajeev Kumar.
Additional solicitor general (ASG) Suryaprakash V Raju informed this to the Supreme Court while hearing bail petition of another ED accused in the same case, Amit Kumar Agarwal.
The ASG informed the court regarding the plan when the division bench comprising Justice Sanjiv Khanna and Justice M.M.Sundresh noted that advocate Kumar has been granted bail in the same case and made it a ground to grant bail to Agarwal.
The Supreme Court has observed the same in its judgment delivered on Friday (December 16).
“It is pointed out that Mr. Rajeev Kumar, the co-accused, has been granted bail. Learned Additional Solicitor General on instructions states that the said order is being challenged,” the apex court observed in its order.
The observation is followed by order granting interim bail to Agarwal and condition the condition imposed for
“In the context of the present case, for the time being, we direct that the petitioner – Amit Kumar Agarwal will be released on interim bail on terms and conditions which will be fixed by the trial court. The petitioner – Amit Kumar Agarwal will provide one mobile phone number on which he can be contacted by the authorities to ascertain his whereabouts, while he is on interim bail. The petitioner will also deposit his passport in the trial court and will not leave India without permission of the Court. The petitioner– Amit Kumar Agarwal will also appear in the office of the Directorate Enforcement as and when summoned,” the order reads.
The apex order clarifies that its order is not a comment on the merit of the order granting bail to advocate Kumar.
“We clarify that this order is not a comment on the merits of the order granting bail to Rajeev Kumar,” the concluding line of the order reads.
