Ranchi: The Jharkhand High Court has upheld the Ranchi Family Court’s decision directing a husband to pay ₹24,000 per month as alimony to his wife. The court dismissed both the husband’s plea to cancel the maintenance order and the wife’s petition to increase the amount to ₹60,000.

Hearing Details and Court Stand

Justice Sanjay Kumar Dwivedi heard the criminal revisions filed separately by both husband and wife. The wife, Chetna Kumar, argued that her husband, Dr. Prasun Kumar, is a renowned neuro-physician in Patna with a monthly income exceeding ₹3 lakh, and requested a higher amount.

The husband contested the Family Court’s decision, claiming he had already paid significant sums and had deposited a lump sum alimony of ₹20 lakh as part of the divorce proceedings.

Wife’s Right to Dignified Living Recognized

The High Court emphasized the spirit of Section 125 CrPC, which ensures that a wife is not left destitute. It stated that a woman has the right to live with dignity, and a husband cannot shirk his legal responsibility by making excuses.

The court concluded that since the wife has no independent source of income, the Family Court had made a reasonable and lawful decision. As a result, both revisions were rejected, and the original order stands.
