Ranchi, April 12: A division bench of Jharkhand High Court comprising Justice S Chandra Shekhar and Justice Rantakar Bhengra today directed Ranchi Municipal Corporation (RMC) and Ranchi Regional Development Authority (RRDA) to furnish all information regarding applications filed for approval of buildings plans.
All information includes the number of applications filed, number of applications pending and number of applications disposed. If the application is pending, what is its status? Apart from this, the court also asked to let the court know the procedure adopted for approval of building plans and through how many places the plans pass to get final approval.
The direction was given while hearing an LPA filed IN 2012 by a noted nephrologist Dr S.S.Prasad, who knocked on the door of the division bench after a single-judge bench of the high court dismissed his petition demanding quashing of demolition notice issued by civic authorities in 2011.
The civic authorities had issued demolition notices following his work of constructing houses without a sanctioned plan. Dr Prasad had challenged the notice saying that he had applied to get his building plan approved in 2007 but he didn’t get any response and was left with no option as, according to the rule, in case of delay a plan is understood to be approved.
After the death of Dr Prasad, his son Dr Rajesh Kumar became a petitioner and the matter was taken into consideration today.
Senior advocates R.S.Mazumdar and Prashant Kumar Singh had appeared on behalf of RMC and RRDA respectively. Singh confirmed the development saying the hearing in the matter was deferred till April 25.
“The petitioner has not got any relief in the matter but the court while hearing the petition gave direction to furnish all the information taking approval of building plans. The court asked them to furnish complete data of applications filed during three years-2019, 2020 and 2021- and their status,” Singh said.
