Ranchi, March 10: The Jharkhand High Court today deferred hearing in RJD chief Lalu Prasad’s bail petition till April 1 paving the path for his Holi celebration in judicial custody.
The development took place in the court of Justice Aparesh Kumar Singh.
Lalu’s lawyer Prabhat Kumar Singh said that ‘the high court has called for the record from the trial court.’
Called for record means that appellate court asks/ calls the lower court to submit its record file/ judicial file related to the matter, an advocate said explaining the meaning of ‘called for record.’
This is the second time the court deferred the hearing in Lalu’s bail petition. Last time, the court deferred hearing on March 4 till March 11 after it found some defects in the bail petition and had asked the petitioner’s advocate to remove the same.
The bail petition was moved on February 24 after the CBI court convicted Prasad on February 15 for his role in a fodder scam involving Rs 139.5 crore of Doranda treasuries. On February 21, the court awarded him five-year imprisonment and imposed Rs 60 lakh as a fine for his crime.
The ailing leader pleaded before the high court seeking suspension of his sentence in the matter and asked for bail on health grounds. His counsel argued that he had served half of the term of the sentence awarded to him.
Lalu is currently under treatment at Rajendra Institute of Medical Sciences in the capacity of a convicted prisoner.
