Ranchi, Nov.9: Holiday no bar for delivering justice. This was reflected today when a division bench of Jharkhand High Court comprising Justice Sujit Narayan Prasad and Justice Ananda Sen heard a habeas corpus petition filed by a lady Sweta Priyadarhni.
The lady knocked on the door of the high court on Monday after a team identifying it as Bihar police from Patna on Sunday night took her husband and a lawyer of the Jharkhand High Court, Rajnish Vardhan, without any assigning reason.
The court heard the petition and fixed the next date of hearing November 25 before directing the Jharkhand government and Bihar government to file an affidavit in the matter. The court, while directing states to file an affidavit, verbally observed that it seems that the advocate was kidnapped.
Earlier, appearing on behalf of the lawyer’s wife advocates Navin Kumar, Dheeraj Kumar and Ritu Kumar argued how come police take anyone without fulfilling the legal procedure and without taking transit remand.
Police reached Vardhan’s residence in Sukhdeonagar locality on Sunday around 10pm and took him with them without giving any information to his family members.
The “Great Writ” of habeas corpus is a fundamental right in the Constitution that protects against unlawful and indefinite imprisonment. Translated from Latin it means “show me the body.” Habeas corpus has historically been an important instrument to safeguard individual freedom against arbitrary executive power.
