Ranchi: The state government has filed an affidavit before the Jharkhand High Court in a case concerning the cancellation of recruitment-related advertisements, asserting that it holds the statutory authority to frame recruitment policy, make appointments and cancel them when necessary.
Government Defends Its Authority Over Recruitment Notifications
The affidavit, filed by JPSC Deputy Secretary Sudhir Kumar, states that advertisement number 21/2023 — issued under notification number LOSEO-6/LOSEA-0107/26 through order 5404 — has been cancelled. This advertisement had been floated for the recruitment of CDPOs (Child Development Project Officers). The court had earlier issued a stay order on the matter, and a petition has since been filed seeking cancellation of this notification. According to the affidavit, the petitioner’s arguments are not valid and the petition should be dismissed.
Petitioner Alleges Improper Process, Government Cites Statutory Powers
The petition challenging the cancellation of the appointment also claims that the government did not issue the cancellation through proper procedure. Responding to this, the government’s affidavit states that it possesses both legal and administrative authority in the matter, and that it exercised its statutory powers to cancel the advertisement under special circumstances. The state government maintains that it is fully competent to take such a decision. The affidavit further notes that the government will present additional grounds for cancelling recruitment-related advertisements during the course of arguments before the court.
