Kejriwal govt moves SC over transfer of Delhi govt’s services secretary

New Delhi, May 12: The AAP-led government in Delhi moved to the Supreme Court on Friday, claiming that the Centre is not implementing the transfer of its services secretary. This comes one day after the Supreme Court decided that the Delhi government has legislative and executive authority over service administration, with the exception of public order, police, and land.

A bench would be constituted to hear the case the next week, said Chief Justice D Y Chandrachud.

Senior advocate A M Singhvi, representing the Delhi government, brought up the situation before a bench of the chief justice and Justice P S Narasimha, stating that because the top court had handed down its decision yesterday, there may now be grounds for contempt.

A bench must quickly hear this case since it may be considered contempt of court under Article 141 of the Constitution, according to Singhvi.

“They are saying we will not transfer anybody. I can file contempt in view of judgement passed yesterday. But it will take time. So kindly list the matter,” he said.

A few hours after the Supreme Court granted the AAP administration jurisdiction over the transfer and posting of personnel in the city, Ashish More, the secretary of the Delhi government’s Services Department, was removed from his position on Thursday.
