Palamu resident knocks ACB door for FIR against pollution board member-secretary

Ranchi, May 15: A Palamu resident, Pankaj Yadav, has requested the Anti-Corruption Bureau IG to register an FIR against Jharkhand State Pollution Control Board member secretary Yatindra Kumar Das for criminal breach of trust and bribery.

Yadav through his complaint informed the state probe agency that Das stayed his own order in lieu of bribe and distributed the bribe amount among those who were eligible to take action against him.

He said the member secretary issued revocation of consent to operate cum closure orders to 60 mining lease/stone crusher units of Sahibganj district in the month of August 2021 on the direction of National Green Tribunal on the allegations of non-compliance of environmental norms. However, he revoked his own orders upon representation of affected parties.

Yadav said the act is in violation of the established principle of law in civil administration that no officer can review his/her own orders. In this case, he said, the appellate authority is Appellate Authority of Jharkhand State Pollution Control Board under the chairmanship of Member, Board of Revenue or National Green Tribunal, Eastern Zone, Kolkata or Principal Bench, New Delhi.
