Ranchi, July 19: The Ranchi Judicial Commissioner is conducting a probe into how a partition suit was filed in the civil court way back in 2007 to divide 40 acres of land making some fictitious persons as the opposition party in the case.
The inquiry is being conducted after the law department referred a complaint lodged by Guman Kacchap with the President of India, who, in turn, sent it back to the Jharkhand Chief Secretary for a proper action.
According to the complaint, a section of persons, including Bandhana Oraon and Domna Oraon, attempted to grab around 13 acres of land in Tupudana by filing a partition suit for division of 40.77 acre of land and making some fictitious persons opposition party in the suit.
“The attempt taken in 2007 came to the fore in June this year after pleader commissioner Prem Prakash prepared a wrong survey report in this connection visiting the spot and while doing so he did some manipulation in documents signed by witnesses,” the complainant alleged.
A civil court lawyer informed this after Prem Prakash’s action got exposed and it was informed to the President of India and other authorities and the President secretariat’s asked the Jharkhand chief secretary to take action in the matter. “The letter was sent on June 16 this year,” he said sharing copy of the letter.
Asked about the manipulation, the advocate said: “The pleader commissioner added some words extra in the vacant space of the document signed by witnesses including Guman Kacchap and others.”
According to Kacchap, he had signed in the paper reading ‘aaj dinank 02.09.2022 din shukravar ko sthan Bagicha Toli, Tupudana, Ranchi Mein Partition Suit No 42/2007 ke sambandh me ukta vaad ke chhanbin hetu evam Takhtav dene hetu dono pakshkaron evam aam grami janta ki maujudgi mein ukta vivarni evam sarni hetu baatchit kiya gaya jusme nimn vyakti evam pakskar upsthit huye’ but latter pleader commissioner added words reading “prativadi bhi upasthit huye lekin apna hastakshar karne se inkar kiya, lekin gramin janta ne vadi plaintiff ka samarthan kiya aur apnka hastakshar banaya. Saath hi saath vadi (plaintiff( ke apna apne hastakshar evam angutha ka nishan diya evam jamin sambandhi kabja ityadi ke bare mein bataya gaya.”
According to Kacchap, Prabhudayal Oraon, Prabhu Sahay Oraon, Markas Oraon, Benjamin Oraon, Budhu Oraon mentioned as opposite party in the partition suit do not stay in the village and all are fictitious. According to him, the duo attempted to grab the land as they are not descendants of Khatiyani raiyat of the village. According Kacchap, the pleader commissioner took signature of the plaintiff’s son and wife as witnesses who are not common villagers.
Asked about the action after the President’s direction, an official of the law department said: “a letter was sent to the judicial commissioner of Ranchi to take action in the matter on June 22. So far, the report is awaited.’
