‘Railways not responsible for safety of unbooked luggage’

Ranchi, July 28: “Yatri Apne Samano Ki Raksha Swan Karen,” assistant standing counsel of the government of India made it clear before the District Consumer Forum when a case of compensation under the consumer protection Act surfaced there.

A resident of Mandar, Murshid Alam, filed a complaint saying a bag containing her wife’s ornament worth Rs 58000 was stolen in between Chunar and Mirzapur when he accompanied by her wife was on way to New Delhi on April 28, 2018 boarding on Jharkhand Swarnjayati Express.

He demanded compensation for the loss in the capacity of a railway consumer. He was of the opinion that he incurred the loss due to deficiency in service on the part of Indian Railways.

In response to this claim, the assistant standing counsel of government of India Parshuram Prasad today appeared in the forum saying that the railway is not responsible for passengers’ luggage not booked after paying its charge.

“If a passenger, who expects compensation for the loss of his luggage, needs to book his luggage giving full details of the materials being booked. If this is not done, the passenger is responsible for the security of the luggage he is carrying,” he said arguing ‘how come railways can know what is inside a bag when it is not disclosed formally.”

The court after arguments deferred the hearing in the matter till August 17.

Standing council Prasad confirmed the development saying he will be able to give any conclusive statement in the matter after a final order comes. “The case was filed on November 21 last year while the luggage was stolen in April, 2018,” he said.
