Ranchi, May 2: The Supreme Court has asked the Jharkhand High Court to dispose of the petition of Sahibganj resident Ashok Yadav in two weeks’ time.
He had challenged his detention under Jharkhand Crime Control Act.
Ashok Yadav is the witness of the Enforcement Directorate (ED) in the illegal stone mining case. In July last year, the district police arrested him in a ship firing case. Later on, in September the district administration recommended his preventive detention under CCA.
Ashok Yadav challenged his detention and filed a Criminal Writ Petition 598/2022 before Jharkhand High Court on November 30 last year. After the expiry of three months the state government extended his detention for another period of three months till March 15 this year.
His petition listed for hearing before the Jharkhand High Court on February 17 and by this time the state government had already extended his detention period.
It was the only hearing that could take place in his matter. On March 15, the state government extended his detention period for another six months. As per the law a person can be detained under CCA till one year only and the detention period can be more than three months at one go.
In between, Ashok Yadav moved the petition before the Supreme Court to challenge his detention despite he had already filed a similar petition before the Jharkhand High Court.
Upon this, the Supreme Court last week directed the Jharkhand High Court to dispose of his petition within two weeks of time.
