New Delhi, Dec 2: The Supreme Court, on Friday, dismissed, the plea challenging order of the Delhi High Court refusing to stay the Municipal Corporation of Delhi (MCD) elections.
The matter was brought before the Justices Sanjay Kishan Kaul and A.S. Oka’s bench. The ruling dismissing the plea was issued by the Bench after Justice Kaul stated, ‘The elections are on Sunday.’
Notably, the elections are scheduled to be held on December 4, as infructuous.
“Passage of time has made the petition infructuous as the election is in 3 days,” said the bench.
Earlier, the Delhi High Court declined to suspend the MCD elections on November 9, 2202. The High Court’s Division Bench stated that it is a well-established legal principle that once an election notification is published, the Court cannot halt it.
However, the National Youth Party, Sanjay Gupta, and a resident welfare association filed three petitions challenging the civic body’s ward delineation, and the High Court gave notice in three of those petitions.
