New Delhi, May 20: The Supreme Court on Friday ordered sharing of three-member inquiry commission’s sealed cover report on the encounter killings of four accused in a case of gang-rape and murder of a veterinarian in Hyderabad.
The apex court had transferred the matter to the Telangana High Court for further action.
Senior attorney Shyam Divan’s request that the report be retained in a sealed cover was rejected by a bench consisting of Chief Justice NV Ramana, Justices Surya Kant and Hima Kohli.
“This relates to the encounter case. There is nothing to keep here. The Commission has found someone guilty. We want to send the matter to the high court,” the bench said.
“We have to send the case back to the high court, we cannot monitor this case. A detailed report is submitted. Question is what is the proper action to be taken. They have made some recommendations,” the bench said added.
Previously, the bench had declined to discuss with counsel the sealed cover report of the Commission headed by top court judge Justice (now retired) VS Sirpurkar, which investigated the four accused’s killing in an encounter.
It had, however, asked its registry to provide a copy of the Justice Sirpurkar probe panel’s findings to the judges on the bench.
Notably on August 3, last year, the Commission, headed by former top court judge VS Sirpurkar, was granted a six-month extension to file the final report on the encounter killings of the four suspects in the gang-rape and murder of the veterinary case.
