New Delhi, Jan 19: The Supreme Court on Wednesday decided to hear a petition challenging the constitutional legality of a clause of the Representation of People Act that led to the use of electronic voting machines (EVMs) instead of ballot papers in the country’s elections.
Chief Justice N V Ramana presided over a bench that heard the arguments of lawyer M L Sharma, who filed the petition in his own name, and said he would consider listing his case.
According to Sharma, Section 61A of the Representation of People Act, which allows for the use of electronic voting machines, was not passed by Parliament and so cannot be enforced.
