New Delhi, Jan 2: The Supreme Court on Monday decided to hear the Uttar Pradesh government’s appeal against an Allahabad High Court ruling that nullified its draft notification for urban local body elections and ordered it to run the elections without reserving any seats for other backward classes on January 4.
The arguments of Solicitor General Tushar Mehta, who was representing the state government, were noted by a bench made up of Chief Justice D Y Chandrachud and Justice P S Narasimha. He said the matter needed to be heard immediately.
“We will take it the day after tomorrow,” the bench said.
In its appeal against the December 27 ruling, the state government argues that the high court cannot invalidate the draught notification dated December 5 that allots seats in urban body elections for other backward classes (OBCs), in addition to those for women, scheduled castes, and scheduled tribes.
The appeal claimed that because OBCs are a segment that is protected by the constitution, the high court erred in invalidating the draft notification. It was filed through lawyer on record Ruchira Goel.
The government of Uttar Pradesh recently formed a five-member commission to examine every aspect of giving OBCs voting rights in urban local body elections.
