New Delhi, Dec 12: Umar Khalid, who was charged with participating in the Delhi riots in February 2020, was given interim release for 7 days on Monday in the Unlawful Activities (Prevention) Act case.
Amitabh Rawat, an additional sessions judge, delayed the ruling on December 7 and granted Khalid a stay of execution so that he may attend his sister’s wedding.
Khalid had sought 14 days’ relief to attend the wedding.
On the last occasion, senior attorney Trideep Pais had argued that Khalid was prepared to follow whatever rules set forth by the court, including being required to reveal his physical location. He referenced rulings in UAPA cases where temporary bail was granted with restrictions.
Pais had additionally stated that Khalid might be subject to the same restriction on media appearances placed on Siddique Kappan by the Supreme Court when granted him temporary release from custody.
“Siddique Kappan granted interim bail by Supreme Court. A condition was put. Please see the condition put – that condition may be put on me. During his visit- he shall not give any media interviews. Not media public persons… Agreed I won’t. Only family and relatives,” he had said.
Pais had stressed that Khalid was committing to not do any interviews because to concerns that he would distribute false information and spark unrest through speaking.
The special public prosecutor, Amit Prasad, had argued that the rulings Khalid had referenced did not apply to the circumstances of the case.
“Here we are in a situation where his bail has been rejected. So far as Siddique Kappan is concerned, it was by Supreme Court… if it is passed by this court, then they will say freedom of expression will be agitated. Tomorrow everybody will say…,” he said.
