New Delhi, May 17: The Supreme Court clarified on Tuesday that the order issued by the Civil Judge Senior Division at Varansi to protect the site where a shivling was allegedly discovered during the survey of the Gyanvapi mosque will not restrict Muslims right to offer namaz and perform religious observances at the mosque.
The court gave notice of the petition filed by the Masjid Committee challenging the Varanasi court’s survey order and adjourned the case to Thursday (May 19).
A panel of Justices DY Chandrachud and PS Narasimha asked the competent District Magistrate to ensure that the location inside the Mosque where Shivling is said to have been discovered is preserved. However, it was decided that this should not limit muslims right to offer namaz.
“We have protected the spot where the shivling was found. And we have clarified that this will not restrict the rights of Muslims. I think this is a balance,” after dictating the order, Justice Chandrachud told Senior Advocate Huzefa Ahmadi, who appeared for the petitioner.
