Jharkhand BJP alleges retired SC judge A.K.Ganguly of committing contempt of court

Ranchi, April 29: BJP spokesperson Pratul Shahdeo alleged former Supreme Court judge Justice A.K.Ganguly of committing contempt of court.

 

Addressing a press conference today,  Shahdeo said the judge gave a clean chit to Jharkhand chief minister Hemant Soren in the matter which is presently subjudice before the Jharkhand High Court. He said the contempt was done on Thursday when the judge using ‘selective judgements’ of the Supreme Court gave an interview to an electronic media channel and gave a clean chit.

 

Informing about the Jharkhand High Court matter which is subjudice, Shahdeo said the matter relates to misuse of official position by chief minister Hemant Soren to benefit himself. The case arose after the chief minister took a mining lease in his own name.

 

Shahdeo said a day after the retired Supreme Court judge gave a clean chit through electronic media to the chief minister in the case of taking advantage of his official position. The JMM today organised a press conference and cited the same judgement the judge had cited during the interview.

 

The act of the judge and the JMM both is contemptuous under section 2 ( c) Contempt of Court Act 1971,  according to which “criminal contempt” means the publication (whether by words, spoken or written, or by signs, or by visible representation, or otherwise) of any matter or the doing of any other act whatsoever which—scandalises or tends to scandalise, or lowers or tends to lower the authority of, any court; or  prejudices, or interferes or tends to interfere with, the due course of any judicial proceeding; or  interferes or tends to interfere with, or obstructs or tends to obstruct, the administration of justice in any other manner.
