Jharkhand HC Halts Police Probe in Minor Road Accident Case, Grants Relief to Petitioner

Ranchi: The Jharkhand High Court has stayed further police investigation in two FIRs linked to a minor road accident, expressing concern over the manner in which the case was being handled. The court also directed that no coercive or pressurising action be taken against the petitioner, Manoj Tandon.

Court Stays Investigation in Both FIRs

Justice S.K. Dwivedi observed that if two cases arise out of the same incident, both investigations should generally be handled by the same investigating officer. The High Court ordered a complete stay on further investigation and proceedings in both FIRs.

No Coercive Action, SSP to Ensure Safety

The court granted interim protection to the petitioner and clearly stated that no coercive steps would be taken against him. It also directed the Ranchi SSP to monitor the situation and ensure the petitioner’s safety. Referring to a Supreme Court ruling, the court emphasised that arrest and investigation must strictly follow prescribed legal guidelines. The next hearing in the matter has been scheduled for March 24.

Accident Happened While Coming to High Court

According to the petitioner, the incident took place on February 17, 2026, when his car lightly collided with a motorcycle while he was on his way to the High Court. He alleged that the police detained him at the police station from 10 am to 5 pm and seized his car, despite not preparing a proper seizure memo.

Allegations of Media Trial and Communal Pressure

The petitioner’s counsel told the court that the police were conducting a media trial over a minor incident. It was also alleged that members of a particular community created a situation where the petitioner’s home and the police station were surrounded, raising serious concerns about law and order.

Notice Under BNSS Must Be Followed

The petitioner also expressed apprehension that he could be taken into custody at any time, despite the requirement under BNSS Section 35(3) to issue notice before taking such steps in relevant cases.
