Ranchi, Jan.21: The Jharkhand High Court has questioned the intention of the apex investigating agency of the country.
It was reflected after the court today verbally observed that the CBI is trying to save the accused of knocking Judge Uttam Anand to death in Dhanbad.
The observation came after the CBI counsel informed the court that the death of the judge was an incident of mobile phone theft.
The court observed that the apex investigating agency of the country failed to reach into the depth of the case because during narco test the accused have admitted that it was in their knowledge that the persons whom they were going to knock is a judge and the moment when the judge was knocked, he was not carrying a mobile but a handkerchief in his hand.
Observing this, the court comprising chief justice Dr Ravi Ranjan and Justice Sujeet Narayan deferred the hearing in the matter for a week.
This is not for the first-time negative observation taking work of the apex investigating has come. Earlier on January 14, the high court monitoring the CBI probe into the judge’s death cases had expressed dissatisfaction over the findings of the apex agency.
Expressing its dissatisfaction over the development in the probe, the court had asked the investigating agency to submit a narco test report today.
The court observed that the investigating agency has submitted a ‘stereo type’ charge sheet and it does not contain any evidence supporting commitment of crime under section 302 of IPC. The court raised doubt over the intention of the CBI in filing the charge sheet. The court commented that the CBI is working like a clerk.
On July 28 Judge Uttam Anand died after an auto rickshaw hit him coming from the backside when he was on a morning walk outside Magistrate Colony near Randhir Verma Chowk in coal city.
CCTV footage collected from the spot suggests that the driver of the vehicle intentionally hit the judge who was walking on the extreme left of the deserted road at the time of incident. The CCTV footage shows that the vehicle changed lanes and hit the judge going extreme left.
Legal fraternity took strong exception to the incident and suspected it a case of attack on the judicial system. The High Court and Supreme Court both took serious note of the matter. The High Court started monitoring the case. Sensing the gravity of the situation, state police constituted an SIT.
Police swung into action and arrested the driver of the auto rickshaw and seized his vehicle. The driver admitted the crime saying he was drunk. The matter was later given to the CBI for probe.
However, nothing specific has come suggesting whether it was an accidental death or a pre-planned murder or something else.
