SC refuses to hear plea seeking uniform dress code in schools

New Delhi, Sept 16: The Supreme Court refused to entertain a Public Interest Litigation petition seeking for the implementation of a uniform dress code in educational institutions across the country on Friday.

A bench of Justice Hemant Gupta and Sudhanshu Dhulia declined to hear the matter.

“This case should not come to the court. We cannot have a uniform school uniform across the country“, Justice Gupta said.

Gaurav Bhatia, a senior attorney and BJP spokesperson, attempted to inform the court that uniformity, not just one uniform, was what was being sought.

In addition to referencing the right to education and the requirement for institutional discipline, he requested uniformity in the dress code for faculty, students, and staff in educational institutions across the nation.

The attorney offered to drop the PIL based on the courts’ unwillingness to consider the matter. The bench agreed to this request.

The Karnataka High Court’s decision, which effectively upheld the prohibition on wearing the hijab at government schools and colleges, is currently being challenged in a number of petitions before the same bench.

Muslim female students from various colleges in Karnataka who had been denied permission to attend class because they were wearing the hijab filed the petitions with the High Court.

The following court date for this matter is September 19, 2022.
