SC sets aside HC order staying Haryana’s 75% jobs quota for locals

New Delhi, Feb 17: The Punjab and Haryana High Court’s judgment to prohibit Haryana’s 75 percent quota in private jobs for locals was overturned by the Supreme Court on Thursday. The state was advised not to take any “coercive steps against the employers” by the Supreme Court.

The high court’s order – to halt the reservation for locals – has been put aside as the court did not give sufficient reasons for staying the law.

The bench consisting of Justices L Nageswara Rao and PS Narasimha asked HC to decide on the issue within a month and direct State govt not to take any coercive steps against the employers for the time being.

The Haryana law, which gives inhabitants of the state 75 percent reservation, was put on hold by the high court earlier this month. The state administration later contested the order in the Supreme Court.

Notably, the Haryana State Employment of Local Candidates Act 2020 provided 75% reservation for local people in private sector jobs having a monthly salary of less than Rs 30,000.

The Supreme Court struck aside the stay order, noting that the High Court had not recorded any grounds for it, and asked the High Court to rule on the case within four weeks.

The state is likewise prohibited from taking coercive action against employers, according to the Supreme Court.

Earlier on February 3, the Punjab and Haryana High Court granted an interim stay on the Haryana government’s bill giving 75% reservation in private sector jobs for state citizens.
