Jharkhand HC reprimands state higher education director over non-compliance of order

Ranchi, Jan.11: Department of Higher, Technical Education and Skill Development in Jharkhand needs proper training to respect laws and orders passed by the judicial bodies.

It was felt so as the Jharkhand High Court directed the director of the department to personally appear on January 21 through video conferencing to address as to why the order of high court has not been complied in spite of assurance.

The direction was given on January 7 after the high court, hearing a contempt petition, observed that the concerned director applied delay tactics before the court and did not honour its word.

The court while giving its observation made it very clear under which circumstances it is giving such direction. The court observed that during a hearing in the matter on December 10 last year the concerned director appearing in person through video conferencing submitted that he had expedited the matter and hopefully the order will be complied in true letter and spirit within a period of ten days.

On his specific assertion, the court posted the case on January 7 but on the same day the counsel appearing on his behalf submitted that an interlocutory application for extension of time has been filed for extending the time to comply with the order passed by the court.

The contempt petition was filed by a section of Ranchi University teachers whose PhD and M.Phil. increment admissible by virtue of UGC 6th pay recommendations was stopped by an order of the said department on June 20, 2013.

The court set aside the order on January 29, 2019 following petitions of affected teachers of Ranchi University and Nilamber Pitamber University. But despite that order, the said increment was not restored and contempt petitions arose.
