New Delhi, Aug 29: In an affidavit opposing Teesta Setalvad’s bail request, the Gujarat police’s special investigation team (SIT) said that witnesses had provided “irrefutable” evidence against Setalvad.
In a case involving accusations of conspiring to fabricate evidence in connection with the Godhra riots, Teesta Setalvad has petitioned the top court for release. The Gujarat High Court gave notice on her request for release on August 4, but set the hearing date until September 19. An urgent hearing of the bail plea was requested by the activist in a motion to the Supreme Court.
After the Supreme Court ruled in the Zakia Jafri case earlier this year that there appeared to be incorrect or misleading information being brought up in the case, the FIR was filed.
However, the Gujarat police claim that their inquiry is not primarily based on the Supreme Court’s ruling in their affidavit.
“Investigation which has commenced and has reached so far, has unearthed pre-meditated and collusive criminal acts by various persons with the petitioner playing a major role in giving effect to the conspiracy for oblique purposes,” claims the affidavit.
The Gujarat government affidavit claims that Teesta’s choice to file a high court petition is a “abuse of process” because she is asking for “special treatment,” even if it omits the names of the suspected political leaders or the purported reason for the plot.
Teesta’s plea will be heard by the supreme court on Tuesday. The apex court stated that they will “had to test whether her incarceration is needed” when giving notice of the case on August 25.
