Ranchi, May 17: The defection case involving BJP legislature party chief Babulal Marandi continues to remain undecided in the tribunal of assembly speaker Rabindra Nath Mahto.
It was expected that some order would be issued on the preliminary objection raised by Marandi taking the petition but the same did not happen. Even the eight points decided for hearing remained unheard.
The eight points included whether giving a letter by Babulal Marandi will be considered as voluntarily leaving the JVM under the 10th Schedule, will he get the benefit of Para 4 of the 10th Schedule or not if Babulal Marandi leaves the BJP alone and whether the claim of the merger based on facts is valid under Para IV of the 10th Schedule or not.
Other points included whether after the expulsion of MLA Pradeep Yadav and Bandhu Tirkey from JVM, whether he remained a legislator of the party or not, whether Babulal Marandi has become disqualified based on Jharkhand Vidhan Sabha Rules 2006 after defection based on facts and constitutional provisions.
Other points included if the membership of Babulal Marandi is disqualified then from which date will it be applicable and whether the application against Babulal Marandi is maintainable due to long delay.
Marandi’s lawyer, R.N.Sahay confirmed the situation saying eight points taken for consideration were not sufficient and he requested the speaker to add some more points but the same was accepted.
Sahay said the speaker during the one and half hour long proceedings asked him to identify the two letters which he had given following the expulsion of Yadav and Tirkey from the JVM.
Earlier on May 6 and May 9, the hearing regarding the defection case of Babulal Marandi was also held in the Speaker’s court, where the tribunal rejected the preliminary objections in the case and directed to hear the matter based on its merit.
Four petitions have been filed against Marandi. The petitioners include former MLA Rajkumar Yadav, JMM MLA Bhushan Tirkey, Congress MLA Deepika Pandey Singh and Pradeep Yadav besides Bandhu Tirkey.
The petitions were filed between December 2019 and January 2020.
